TERMS OF USE

These Terms govern the use of the NiteSeek application during its Australian MVP launch.
ACCEPTANCE
By creating an account or using NiteSeek, you agree to these Terms.
ELIGIBILITY
NiteSeek is intended only for users aged 18 years or older.
You must be at least 18 years old to create an account or use NiteSeek.
USER RESPONSIBILITIES
Users are responsible for their accounts, passwords, conduct, and all content they publish.
PROHIBITED CONDUCT
The following conduct is prohibited:
• Fake profiles or impersonation.
• Stalking, harassment, intimidation, or threats.
• Scams, phishing, or fraud.
• Hate groups or hate speech.
• Publishing another person's private information.
• Illegal activities including drugs, weapons, or terrorism.
• Uploading unlawful or infringing content.
REPORTING, INVESTIGATION AND ENFORCEMENT
Users may report accounts, messages, groups, venues, events, or other content they believe violates these Terms or applicable law.
NiteSeek may, but is not obligated to, review, investigate, or act upon any report or suspected violation.
The availability of reporting tools does not create any duty for NiteSeek to monitor the platform, investigate every report, or proactively supervise user activity.
NiteSeek may, at its sole discretion, remove content, delete messages, restrict features, suspend or permanently terminate accounts, groups, venues, or events whenever it reasonably believes such action is appropriate to protect users, enforce these Terms, or comply with applicable law.
NiteSeek may preserve relevant information and cooperate with law enforcement or competent authorities where required by law.
USER-GENERATED CONTENT
Users remain solely responsible for all content they publish.
PERSONAL SAFETY
NiteSeek does not verify users, perform criminal background checks, or guarantee the identity or behaviour of any person.
Users are responsible for their own decisions and safety.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, NiteSeek is not responsible for disputes, stalking, scams, fraud, assaults, theft, injuries, or damages arising from interactions between users or attendance at venues or events.
SUSPENSION AND TERMINATION
NiteSeek may suspend or permanently terminate any account without prior notice where it reasonably believes these Terms have been violated or where necessary to protect the platform or its users.
GOVERNING LAW
These Terms are intended for the Australian MVP launch and are governed by the applicable laws of Australia, subject to mandatory consumer protections.
